Terms of Service

These terms govern how clients and freelancers use Tentise to scope, pay for and deliver digital work.

Last updated November 6, 2026

1. Accounts & eligibility

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account, company and billing details and for all activity under your login.

2. Independent contractor classification

Freelancers are independent contractors, not employees, agents or partners of Tentise or of any client. Freelancers control their methods, hours and tools, supply their own equipment, and are solely responsible for their taxes, insurance and legal compliance.

Tentise is a marketplace and payment facilitator. We do not supervise or direct the work.

3. Platform escrow agreement

When a client places an order, the full order amount is collected and held by Tentise's payment partner in escrow. Funds are released to the freelancer only when:

  • the client accepts the delivery, or
  • the client does not respond within 3 days after delivery (auto-acceptance), or
  • a dispute is resolved in the freelancer's favor.

See the Escrow & Refund Policy for full release, dispute and refund rules.

4. Fees

During the launch promotion, clients pay a 10% Client Escrow & Quality Protection Fee, which is Tentise's entire platform revenue. Card and payment gateway costs (currently 2.9% + $0.30) are charged to the client as a separate pass-through line item on the invoice and are never deducted from the 10% fee or from seller earnings. Founding Sellers pay a 0% platform fee and receive 100% of their listed price. We will give at least 30 days' notice before any seller fee is introduced. Fees are non-refundable except where the Refund Policy says otherwise.

5. Non-circumvention

For 24 months after first connecting on Tentise, clients and freelancers agree not to arrange, request or accept payment for services outside the platform. Sharing contact details to move work off-platform is prohibited. Violations can result in suspension and a conversion fee equal to 15% of the estimated off-platform value.

6. Intellectual property transfer

Freelancers retain ownership of delivered work until final payout. Upon release of escrowed funds for an order, all rights, title and interest in the final deliverables transfer to the client, except pre-existing tools, libraries and open-source components, which are licensed to the client on a perpetual, non-exclusive basis.

Freelancers may display non-confidential work in their portfolio unless the client opts out in the brief.

7. Acceptable use

You agree to follow the Trust & Safety Code of Conduct. We may remove content, hold funds or suspend accounts that violate it.

8. Limitation of liability

To the extent permitted by law, Tentise's total liability for any claim is limited to the fees we received from you in the 6 months before the claim.

9. Governing law & changes

We will notify you of material changes at least 14 days in advance. Continued use after changes take effect means you accept them.
